Due to the imminent risk of large-scale digital piracy, particularly in relation to the Indian Premier League 2025, the Plaintiff sought urgent relief, including real-time blocking of rogue websites and mobile applications. In this case, the Court acknowledged that the Plaintiff is the true owner of its content and observed that these unknown defendants were engaged in organized violations of its intellectual property rights. Given the rapid emergence of mirror/redirect/alpha-numeric variants of rogue platforms, the Court emphasized the need to protect the Plaintiff’s rights in the virtual space, and accordingly introduced an extended form of the existing “dynamic+ injunction,” referring to it as a “superlative injunction.” This enhanced form of injunction brings mobile applications within the ambit of real-time enforcement, that was not previously granted, and enables the Plaintiff to obtain real-time relief against the unknown defendants, irrespective of the mode of dissemination.
