The Delhi High Court issued an interim injunction to protect the intellectual property rights of the film, Andaz Apna Apna. The Plaintiff, Vinay Pictures, alleged that multiple third parties are unlawfully exploiting the film’s characters, dialogues, catchphrases by creating AI-generated content, including videos and stickers, merchandise including clothing items, mugs, posters, using the film’s well-known dialogues/catchphrases as part of domain names, etc. The Court acknowledged that such unauthorized use of various elements of the film constitutes infringement of the Plaintiff’s intellectual property and held that only the Plaintiff has exclusive rights to commercialize these elements. The Court also noted that these AI-generated content and merchandise are mistakenly associated with the Plaintiff, causing economic and reputational harm to the Plaintiff.
