In the matter of Lifestyle Equities CV & Anr. v. Amazon Technologies Inc., the Single Judge awarded damages amounting to ₹336 crores. On appeal, the Division Bench stayed the execution of the decree without requiring any security or deposit. While the general principle, as laid down in Malwa Strips Pvt. Ltd. v. Jyoti Ltd., is that money decrees ought not to be stayed without security, the judgment also recognizes that a stay may be granted in exceptional circumstances. The Division Bench noted several concerns with the judgment, including the inflation of the damages beyond the original pleadings and the conduct of ex parte proceedings without proper service of summons. Taking into account these procedural lapses, the Division Bench held that this was an exceptional case in which the operation of the decree could be stayed without requiring security. Consequently, Amazon was permitted not to pay damages until the final decision in the appeal is pronounced.
