Suit Filed by ANI Against Open AI, Restricting Use of Copyrighted Materials to Train AI Models

By way of an ongoing proceeding before the Hon’ble Delhi High Court, ANI Media recently filed a copyright infringement claim against OpenAI, seeking to restrain OpenAI from using copyrighted materials to train its AI models. The primary issues to be decided by the Delhi HC are: (1) Whether the storage of ANI’s data for training Open AI’s ChatGPT system amounts to infringement?; (2) Whether the use of data to generate responses for users of ChatGPT amount to infringement?; (3) Whether Open AI’s use of ANI copyrighted materials qualifies as ‘Fair Use’ under Section 52 of the Indian Copyright Act, 1957 ?; (4) Whether Indian Courts have jurisdiction for the present lawsuit?

The matter is next listed for further submissions on January 23, 2026.
