CCPA Issues Advisory to E-Commerce Platforms to Audit and Eliminate Dark Patterns

The Central Consumer Protection Authority (CCPA) issued an advisory directing all e-commerce platforms to identify and remove dark patterns i.e., deceptive design practices that mislead or manipulate consumers. E-commerce platforms are directed to conduct self-audits within three months and ensure compliance with the Guidelines for Prevention and Regulation of Dark Patterns, 2023. To support enforcement, the Department of Consumer Affairs has also constituted a Joint Working Group (JWG) to help identify violations and suggest consumer awareness initiatives. As per the Guidelines, 13 dark patterns have been defined, which include false urgency, basket sneaking, confirm shaming, drip pricing, and others.
